1. Acknowledgement of Risk
I understand that participation in sports training activities, including but not limited to soccer and baseball, involves inherent risks, including but not limited to physical injury, illness, property damage, or death. These risks may result from my own actions, the actions or negligence of others, or the condition of the facility, equipment, and environment.
2. Voluntary Participation
I voluntarily choose to participate (or allow my legal child/participant to participate) in training sessions, practices, classes, and activities offered by Prodigy Development Center, including Prodigy Futbol Development and Prodigy Baseball Development, and I assume full responsibility for all associated risks.
3. Release of Liability
In consideration for being allowed to use the facility and participate in training activities, I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release and hold harmless Prodigy Development Center, Prodigy Futbol Development, and Prodigy Baseball Development, including their owners, directors, officers, managers, employees, contractors, volunteers, trainers, agents, affiliates, representatives, coaches, and landlords (“Released Parties”), from any and all liability, claims, demands, losses, or damages arising out of or related to any injury, disability, death, or property damage, whether arising from the negligence of the Released Parties or otherwise.
4. Assumption of Risk
I understand and accept that sports and physical training, including soccer and baseball, involve significant risks. I knowingly and freely assume all risks, both known and unknown, even if arising from the negligence of others, and I accept full responsibility for my participation (or my legal ward/participant’s participation).
5. Medical Authorization
In the event of injury or illness, including to participants and bystanders, I authorize Prodigy Development Center, Prodigy Futbol Development, and Prodigy Baseball Development and their staff to obtain medical treatment deemed necessary. I accept responsibility for all related costs.
6. Facility Use Agreement
This waiver applies to all uses of Prodigy Development Center, Prodigy Futbol Development, and Prodigy Baseball Development facilities, including soccer fields, batting cages, weight rooms, training equipment, restrooms, and all surrounding areas, whether for scheduled activities or informal use.
7. Indemnification
I agree to indemnify and defend the Released Parties from any and all claims, causes of action, damages, judgments, costs, losses, or expenses (including attorney’s fees) that may arise due to my participation or the participation of my legal ward/participant in activities at the facility.
8. Photo & Media Release
I give Prodigy Development Center, Prodigy Futbol Development, Prodigy Baseball Development, and hired photographers permission to use photographs or video footage taken of me (or my legal ward/participant), all parties, and participants during participation for marketing, social media, promotional, or training purposes. I understand that no compensation will be provided.
9. Governing Law Jurisdiction
This agreement shall be governed by and interpreted in accordance with the laws of the State of Colorado. Any legal proceeding arising from this waiver shall be brought in a court of competent jurisdiction, and I agree to go through the process of civil mediation before taking any claims to court, located in El Paso County, Colorado.
10. Severability
If any portion of this agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
